These Terms of Service explain the rules for using Tale of Life. They work together with our Privacy Policy to govern your relationship with us.

Important note: This document is a business draft for Tale of Life. It is not legal advice and does not confirm compliance with every law that may apply in the European Union, Estonia, the United States, or other countries. Before relying on it as final, a qualified attorney should verify the age requirements, consumer rights, liability limitations, dispute provisions, privacy obligations, and user-generated-content rules.
1. About Tale of Life
These Terms of Service (the “Terms”) govern your access to and use of Tale of Life, a platform for writing, organising, preserving, and sharing personal life stories (the “Service”).
White Swan OÜ, an Estonian company based in Tallinn, Estonia, operates the Service (“Tale of Life,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not create an account or use the Service.
2. Eligibility and accounts
You must be at least 16 years old to create an account, in line with the GDPR’s default age of digital consent, unless a different minimum age is required by the law that applies to you. If you are under the age of legal majority where you live, you may use the Service only with the consent or involvement that applicable law requires.
In addition, when you register, you agree to:
- Provide accurate and current information
- Keep your login details confidential
- Notify us promptly if you believe your account has been accessed without permission
- Use only your own account
- Update your information when it changes
You are responsible for activity on your account, unless that activity resulted from our own failure to apply security measures the law requires.
3. What the Service is and is not
In short, Tale of Life provides tools for personal storytelling. It is not a medical, therapeutic, legal, financial, genealogical, archival, or emergency service.
The Service does not guarantee that we will preserve any story forever. For that reason, you should keep your own copies of important content. We may make backups, but backups do not substitute for a copy that you keep yourself.
4. Your content and ownership
However, you retain ownership of the text, photographs, recordings, and other material that you submit to the Service (“Your Content”), subject to the rights of third parties whose material you include.
You grant Tale of Life a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, transmit, and technically modify Your Content only as reasonably necessary to:
- Provide and operate the Service
- Display Your Content to the audience you select
- Create backups and protect against data loss
- Secure, maintain, and improve the Service
- Comply with legal obligations or enforce these Terms
This licence ends when Your Content is deleted, except to the extent that copies remain temporarily in secure backups or must be retained for legal, security, fraud-prevention, or dispute-resolution purposes.
We will not sell Your Content or use Your Content to train general-purpose AI models unless we first obtain your separate, informed permission or clearly update the applicable terms and obtain any consent required by law.
5. Your responsibilities for Your Content
You are responsible for Your Content and for ensuring that you have the rights and permissions needed to submit it.
You must not submit or share content that:
- Violates applicable law
- Infringes copyright, trademark, privacy, publicity, confidentiality, or other rights
- Is defamatory, fraudulent, threatening, harassing, hateful, or abusive
- Impersonates another person or organisation
- Includes malware, malicious code, or harmful links
- Is unsolicited advertising, spam, or commercial promotion
- Exposes another person’s sensitive personal information without an appropriate legal basis or permission
- Aims to exploit, endanger, or harm a child or vulnerable person
Your stories may include sensitive subjects. Do not submit information about another person unless you have a lawful basis to do so. You should also avoid including passwords, payment details, identity-document numbers, or information that could create a security risk.
6. Story visibility, invitations, and shared stories
You may be able to choose whether a story or chapter is private, visible to selected friends or invited people, or publicly visible. The available settings may vary by feature.
You are responsible for reviewing the visibility setting before sharing Your Content. Content that you make public may be copied, saved, indexed, or redistributed by other people, and we cannot control copies made outside the Service.
If you invite another person or add them as a contributor, you confirm that the invitation is relevant to a genuine personal relationship or legitimate storytelling purpose and is not unsolicited bulk email or spam.
A person who receives access to a shared story may be able to view it while that access remains active. You should review and revoke access when appropriate. If you are named as a contributor or co-author, access to the relevant shared story may continue according to the sharing settings and the feature’s design.
7. Acceptable use
You must not:
- Use the Service for unlawful, fraudulent, or abusive purposes
- Attempt to access another user’s account or private content
- Bypass privacy, security, rate-limit, or access-control features
- Scrape, copy, or systematically collect user content or personal data without permission
- Interfere with the operation of the Service
- Upload code or files intended to damage the Service or another user’s device
- Use automated systems in a way that creates unreasonable load or circumvents restrictions
8. Moderation and reports
We may review, restrict, remove, or disable access to content or accounts where we reasonably believe this is necessary to:
- Comply with law or a valid legal request
- Enforce these Terms
- Respond to a report of abuse or infringement
- Protect users, the public, or the Service
- Prevent fraud, spam, security incidents, or technical harm
Where required by applicable law, we will provide notice and any available review, appeal, or complaint process.
To report content or account abuse, contact safety@talesof.life and include enough information for us to investigate.
9. Privacy
Our Privacy Policy explains what personal data we collect, why we process it, how long we retain it, which service providers may receive it, how international transfers are handled, and how you may exercise your privacy rights.
The Privacy Policy forms part of these Terms. If there is a conflict between these Terms and the Privacy Policy concerning data protection, the Privacy Policy applies to that data-protection issue.
10. AI-assisted writing features
If we offer AI-assisted writing features, those features are optional unless clearly stated otherwise.
Depending on the feature, Tale of Life or an AI service provider may process text you submit. Specifically, before enabling an AI feature for private stories, we will explain what content is sent for processing, which provider processes it, whether prompts or outputs are retained, whether the provider may use the content for model training, where processing takes place, and how you can disable the feature.
AI-generated suggestions may be inaccurate, incomplete, or unsuitable. You are responsible for checking any suggested text before saving or sharing it. The AI feature must not be treated as a source of factual verification, professional advice, or an instruction to invent events in a person’s life story.
11. Availability and changes to the Service
The Service is under active development. We may add, remove, suspend, or modify features, sections, integrations, or designs.
We will make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted, secure, or error-free operation. Planned maintenance, security events, technical failures, legal requirements, and events outside our reasonable control may affect availability.
12. Fees and future paid features
The Service is currently free.
If we introduce paid features, we will provide the applicable price, billing terms, renewal terms, cancellation rules, and any legally required pre-contract information before charging you. Mandatory consumer rights are not limited by this section.
13. Account closure and termination
You may close your account at any time by using the available account controls or contacting contact@talesof.life.
We may suspend or terminate an account where we reasonably believe that the user has:
- Seriously or repeatedly violated these Terms
- Engaged in fraud, spam, abuse, or security attacks
- Created a legal or safety risk
- Used the Service in a way that threatens the Service or other users
Where applicable law requires it, we will provide notice and an opportunity to remedy the issue or appeal the decision, except where immediate action is necessary for security, legal, or safety reasons.
When an account is closed, we will handle personal data and Your Content as described in the Privacy Policy. Some information may remain temporarily in backups or be retained where required by law or reasonably necessary to establish, exercise, or defend legal claims.
14. Intellectual-property rights in the Service
The Service, including its software, design, branding, logos, text, layout, and original features, belongs to Tale of Life or its licensors and is protected by applicable intellectual-property laws.
Except as expressly allowed by these Terms or applicable law, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service.
15. Third-party services and links
The Service may use or link to third-party services, including authentication, translation, speech recognition, storage, and email delivery.
Third-party services may have their own terms and privacy policies. We are not responsible for a third party’s independent services, content, security, or privacy practices. We will disclose material third-party processing in our Privacy Policy where required by law.
16. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as available” basis. We do not promise that the Service will meet every user’s requirements, preserve every item of content without interruption, or be free from errors or harmful components.
Nothing in these Terms excludes or limits warranties, remedies, or rights that cannot lawfully be excluded or limited, including mandatory consumer rights.
17. Limitation of liability
To the maximum extent permitted by applicable law, Tale of Life will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, business opportunity, goodwill, or data, arising from or related to the Service.
To the maximum extent permitted by applicable law, we limit our total liability for claims arising from or related to the Service to the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or €0 if you have not paid us anything, since the Service is currently free.
These limitations do not apply to liability that cannot legally be limited, including liability for fraud, wilful misconduct, death or personal injury caused by negligence where applicable, or other mandatory liabilities under applicable law.
18. Indemnity
To the extent permitted by applicable law, you agree to reimburse Tale of Life for reasonable losses, claims, and costs arising from your unlawful use of the Service, your material breach of these Terms, or Your Content infringing another person’s rights.
This section does not require you to indemnify us for losses caused by our own unlawful conduct or negligence where such limitation is prohibited by law.
19. Governing law and disputes
These Terms are governed by the laws of Estonia, excluding conflict-of-law rules, except to the extent that mandatory consumer-protection laws in your country of residence apply.
Before starting formal proceedings, the parties should first try to resolve the dispute by contacting contact@talesof.life. You may also have the right to bring a claim before the courts available under the mandatory laws of your country of residence.
20. Changes to these Terms of Service
We may update these Terms as Tale of Life evolves — for example, as new features or integrations are added. For material changes, we will let you know by email or with a notice on the site before the change takes effect, and we will update the “Last updated” date above when changes are made. Continued use of the Service after changes means you accept the updated Terms of Service; if you do not agree, you may close your account before the changes take effect.
21. General provisions
If a court or competent authority finds part of these Terms invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Our failure to enforce a provision immediately does not waive our right to enforce it later.
You may not transfer your account or rights under these Terms without our written permission, unless applicable law otherwise permits the transfer. We may transfer our rights and obligations as part of a merger, restructuring, sale, or transfer of the Service, subject to applicable law and user rights.
These Terms of Service, together with the Privacy Policy and any feature-specific terms, form the agreement between you and Tale of Life concerning the Service.
